This is an action about the deliberate targeting of elderly and vulnerable consumers for the sale of unsolicited and unnecessary HVAC and related equipment. It is alleged that the corporate defendants engaged in unconscionable business practices that included high-pressure sales, non-disclosure of information (that was material and statutorily mandated), and the unlawful encumbrances on residential home titles to extract grossly inflated and previously undisclosed amounts from British Columbia consumers.
The action concerns the breaches of the Business Practices and Consumer Protection Act, S.B.C. 2004, c.2 (the “BPCPA”), slander of title, abuse of process, conspiracy and unjust enrichment by the defendants in order to profit at the expense of British Columbia consumers.
